These Terms of Use are between you and CYBRCOAST LLC, a Delaware, USA company, for your use of the public Swayed Media website and pre-launch waitlist. By using the website, you agree to these terms. If you do not agree, please do not use it.

This site is for information and waitlist signups. It does not currently let you open a campaign account, place an order, pay for a campaign or receive a creator payout. Separate platform and campaign terms will be shown before any such transaction becomes available.

You must be at least 18 and provide a name and email address you are permitted to use. Joining is free and does not guarantee an invitation, launch date, eligibility, campaign opportunity or future service availability. We may limit or remove entries that appear false, abusive or automated.

We will use your details as described in our Privacy Notice. You may ask to leave the waitlist at any time.

The Swayed name, site design, text, illustrations and other original materials belong to CYBRCOAST LLC or its licensors. You may view the website for your own evaluation, but may not copy, scrape, republish, reverse engineer or misuse it except as permitted by law or with our written permission.

As an exception, Swayed templates explicitly offered for downloading or copying may be copied, edited and shared for your own campaign planning and reporting. This permission does not cover third-party content and does not imply that a template has received legal review.

Do not interfere with the website, try to access non-public systems, submit malicious code, impersonate others, or use the waitlist for spam or unlawful purposes.

The site may link to or embed content from services such as TikTok. Those posts belong to their respective creators and platforms. They are independent examples of creator-led promotion, not Swayed campaigns or endorsements of Swayed by those creators or brands. We do not control whether an external post remains available, and external services have their own terms and privacy practices.

Descriptions of campaign features, fees, timing and payouts explain the intended product and may change before launch. They are not an offer to process a campaign today. Before any paid campaign is funded, the brand and creator will be shown the applicable platform terms, Campaign Order and checkout amounts.

Our intended funding policy is that brands pay upfront, creators earn only for work that meets the agreed Campaign Order, and unused funded amounts and their associated platform-fee portion remain available as a Swayed account balance for future work. Unused amounts are not automatically refunded to the original payment method. We do not offer routine refunds; exceptional requests may be reviewed by Swayed’s owners through support, and refunds will be made where required by applicable law. The final terms presented at funding will govern an actual paid transaction.

We may update, suspend or discontinue the website or waitlist. We try to keep information accurate, but pre-launch descriptions, illustrations and estimated workflows may change. We may update these terms by posting a new version with a revised effective date. Continued use after an update means you accept the revised terms, to the extent permitted by law.

The website is provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties, including fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted access or that pre-launch descriptions will match the final product.

To the extent permitted by law, CYBRCOAST LLC is not liable for indirect, incidental, special or consequential losses arising from use of this informational site. Nothing in these terms limits liability that cannot lawfully be limited or affects rights you cannot waive.

These website and waitlist terms are governed by the laws of Delaware, USA, without regard to conflict-of-law principles, except where mandatory local law applies. Any dispute concerning these terms will be brought in the state or federal courts located in Delaware, unless applicable law requires another forum.
